High Court challenge over noise - guess who's back...

All I need to say is that the Ropers are at it again. If they're so unhappy with Alton Towers being on their doorstep, why don't they just move house? Grrr... [/radge]

In their defence, they were there first, some 12 years before Corkscrew even opened.

However, in 2004 they resolved noise levels to their content when the speakers from the top of Oblivion were removed - but now they are seeking damages dating back to 1998? I think this will be thrown out yet again.

I would like to contact them and perhaps ask them if I could visit their house to hear for myself exactly what is audible there on a busy summer's day - but I somehow doubt they'd be very forthcoming.

Awwwww, this feels like a nostalgia trip!

TTF's oldest meme is back! Haha, takes me back to when I first read the forums back in 2004!

It'd be ironic if they turned out to be Premium pass holders.

This really is just stupid now. Apparently they have indeed moved house but still own their property in Atlon hence why they are still going ahead with this. Obviously I can't be sure if that is true or not but if they are not actually living in Alton then does it really matter.

Plus I know the majority of the resident's in Alton do not have a problem with the theme park, they understand the huge benefits it brings to the local area. The Ropers are clearly just the type of people who like to make a big deal about things and they like seeing their names in the press. I hope they lose more money over this case, it would serve them right as far as I'm concerned.

:)

Extremely annoying. There I was thinking just the other week how Towers should focus there efforts on getting the noise abatement order lifted or adjusted in some way, but now surprise surprise the ropers are back again.

They're going to ruin this themepark.

Quoting back in 2004 their argument was..
If you live within I would suggest a mile or any more of Alton Towers, your windows literally shake and if you go outside, the ground shakes - Stephen Rope
Strange that, i've never felt Alton Towers shake, wonder what they make up this time
The thirteen wraith's keep knocking on their door? ;)
Is their any point, if you wanted to get into the papers at least do it without bringing country's biggest theme park into it

They won't ruin anything, fortunately judges are intelligent people (on the whole) and the case will be dismissed in due course, I'm sure.

I have removed some posts, can we all think a little bit before we post, a lot of the posts in here didn't contribute to the debate.

If you want to discuss this new try and present your views properly like many others have done.

Thanks.

Mr Justice Hickinbottom adjourned the matter to give the Alton Towers management a chance to prepare for the case when it comes back to court.

However, in doing so he said he did it 'with a heavy heart' bearing in mind the escalating costs of the proceedings.

He continued: "The costs of this claim are very considerable. By adjourning today's appeal, those costs can only be increased. Richard Buxton, solicitor for the claimants, has indicated that if this appeal is unsuccessful there will be grave financial difficulties for the claimants."
So why are they going ahead with this? :|

I've got no idea, Al. To be honest, I don't think that they'll win. As I stated in my previous post, if they're not happy with living near Alton Towers, then they should just move house. Problem solved.

From TT News:
Stephen and Suzanne Roper, owners of the company Churchill China, are once again seeking compensation from Alton Towers for noise disturbances, which the couple claim have affected them at their Farley residence.

The Ropers' legal battles with the park began in 2002, with one notable product being the noise abatement order which the couple managed to secure after lenghty proceedings in 2007. However, their persistent claim for an injuction and compensation was, again, thrown out by the High Court in January of this year, a decision which the couple described as "Draconian and disproportionate".

However, a more senior judge, Mr Justice Hickinbottom, has renewed the couple's hope, adjourning the case to give Alton Towers' management time to prepare for the case's return the courtroom. This was a move taken with reluctance on his part, however, and with escalating legal costs, the Ropers will be footing a hefty bill in the event of an unsuccessful appeal.

In the unfortunate event of this appeal being successful, the Ropers' injuction claim would result in Alton Towers both having to pay damages for the noise since 1998, and also having to close or relocate certain attractions, in order to end the "misery" which Mr Roper believes is afflicting "many others in Farley and Alton".

TowersTimes will be bringing you all the latest on this legal case as it progresses, and the issue can be discussed on our popular discussion forums!

Yeh, it's not even that bad from the car park, never mind a mile away. Obviously exaggerated way out of proportion.

Since 1968 according to the articles.

That link that Neil posted above is surprising. The Ropers have a bloody nerve taking Alton to court when they're doing that. Nimby's tbh.

GUYS!

would it in any way help if we started some form of petition or group of signatures against the ropers and in favor of alton towers? i don't know if this would make any effect on the deal or not. but thought i would throw my idea out there.

Alton Towers as a theme park opened in 1980.

That's 30 years to adjust or move out. It's not as if they woke up one morning with ten thousand cars tearing past their house to visit this big collection of huge rides.

It's like choosing to live next to an airport then complaining about the noise. Put up or get out.

I find it funny that they continue to complain, even though they have failed around 3 times now.
These 'people' do not know what is good for their town. Without AT, the town would be in ruins, it would have no money and they would be the only people who are happy with it, just because a theme park got shut down.
This is ridiculous!
I might go to court and give evidence against the Ropers! They do not know the definition of fun!
Why don't AT just give them money and say "Go and buy a new house then! Do you hear anyone else complaining?"
